The
Family Court
Division of the Miami-Dade County Clerk's Office was established
in January, 1992. This Division handles two broad category of
cases: Domestic Relations and Probate. In the Probate Category,
Estate, Guardianship and Mental Health cases are filed, processed
and maintained. Dissolution of Marriage, Child Custody and Support,
Paternity, Adoption, Name Change and other related actions are
maintained in the Domestic Relations Category as prescribed
by the applicable laws and rules of the State of Florida.
Overall, the Family Court Division provides clerical
support to more than Nineteen Circuit Judges and ten General
Masters. More than 35,000 new cases are filed and maintained
annually.

How
to modify a Final Judgment of Dissolution of Marriage
If
you are seeking to modifying the terms and conditions of your
final judgment or decree, you must file a written petition for
modification along with the appropiate filing
fee. *We are unable to assist you in drafting
your petition or any other aspect of your case that requires
legal knowledge. If you are a pro se litigant contact an attorney,
or Self Help Program to prepare or review your pleadings. Pursuant
to local rule established May 11, 1997 all pro se parties requesting
modification petitions, must have petitions reviewed prior to
filing by the Self Help Program located at:

How
to enforce a Final Judgment
If you are seeking to enforce a final judgment or other court
orders you must file a written motion and schedule a hearing
with the office of your assigned judge. The party requesting
enforcement is responsible for scheduling a hearing with the
office of the assigned judge. *We are unable to assist
you in drafting your petition or any other aspect of your case
that requires legal knowledge. If you require legal assistance

How
to set a Family Matter
If you wish
to set a case on the judges motion calendar, you may file the
notice of hearing with the motion attached at least five (5)
working days prior to the judges scheduled motion calendar days.

If you are an attorney and need to set an uncontested matter
for final hearing and you have verified that an answer and waiver
or default has been filed in the court file please call (305)
349-6048. If you need to set a contested matter on the judges
calendar please contact the judges office.

How
to Reactivate or Reassign cases
If you need to reactivate and
or reassign an existing case to a family judge, you may do so
in writing by providing us with the case number, name, address
and reason for your request to the Family Reassignment Desk
at, 175 N.W. 1st Avenue, Suite 1200, Miami, Florida 33128.
How
to obtain a copy of a Pleading or an Order
Copies
can be obtained by visiting our office in person or mailing
in your request. Visit the fee
schedule for a list of our copies and certify
document fees. When mailing in your request please include
the name of the parties, case number or the approximate year,
along with a self addressed, stamped envelope and the appropriate
fees to assure receipt of the documents requested.
Due to changes in F.S. 63.062 the claim of paternity registration form for the Florida Putative Father Registry is now made available by the Department of Health, Office of Vital Statistics and the offices of the clerks.
