What types of cases are heard in Traffic Court?
The Traffic Division hears criminal traffic cases and civil infraction cases.

What is a criminal traffic offense?

A criminal traffic offense, such as driving under the influence, fleeing a police officer or leaving the scene of an accident, requires a court appearance and it carries with it criminal penalties which may include a fine, court costs and/or the possibility of a jail term.  Persons charged with a criminal offense will receive a notice of hearing sent to the address listed on the charging document. 

 

What is a civil traffic infraction offense?

A civil traffic infraction is a non-criminal charge that can be disposed of by payment of a civil penalty, requesting a court hearing, or election of a defensive driving course.  A court appearance is not required, except in cases where the violation involves serious bodily injury or death of another person.  

 

How soon after issuance must I pay the ticket?

Upon receipt of a traffic ticket issued to you for a civil infraction, you have 30 days from the date of issuance to satisfy your obligation. Failure to satisfy your citation(s) by selecting one of the options within 30 days of the issue date will result in the suspension of your driver's license and will require the payment of late fees.

 

What if I have moved since I have received the ticket?

You may submit an address change in person at any Clerk's Office location or by mail to the address listed below.

What are my options?

If you are charged with a civil infraction you may: 

A.  Pay the civil penalty

  • Points will be assessed against your license when applicable.

  • You may pay in person, by mail or by phone.  Payment can be in the form of cash, check, money order or credit card.  You may pay by check, money order or by Visa or MasterCard.

  • Payments can be mailed to P.O. Box 02-5450, Miami, FL. 33102-5450.


  • Be sure to include the citation number, driver’s license number and defendants name to ensure proper payment application.  Do Not Send Cash Through the Mail. 


  •  If you are paying by using your Visa or MasterCard you must indicate which credit card you are using, enter the credit card number, the expiration date, print your name as it appears on the credit card and sign your name.

B.   Attend a defensive driving course

  • Points will not be assessed against your license. This option does not apply to driver’s license, tag, registration or P.I.P. insurance violations.

  • You are eligible to elect four hours traffic school once every twelve months for a maximum of 5 times in a lifetime; if you are not eligible you may request an eight hour traffic school once in your lifetime.

  • If you elect to attend traffic school and do not comply within 120 days of election, you will be subject to point assessment and additional fees, along with suspension of your drivers license.

C.   Request a Court Hearing

  • You may plead not guilty and request a court hearing in person, by mail, or by phone within 30 days of the date of issuance of the citation.  You will receive notice of your hearing date, time and location within six to eight weeks at the address listed on the citation.  At the court hearing if it is determined that an infraction has been committed the court may impose a civil penalty not to exceed $500.00, or require attendance at  a traffic school, or both. 

  • On violations  involving death or speeding in a school/construction zone the the fine shall not exceed $1,000.00.

Failure to complete court ordered traffic school or failure to pay court costs will result in your driver's license being suspended until compliance requirements are met.


Can I attend Traffic School outside Miami-Dade County?
Yes, you may attend traffic school in any county within the state of Florida.  You  must complete the course within 120 days and submit your Certificate of Completion to the  Miami-Dade County Clerk's Office.


How many points will be assessed against my driver's license?
Upon, payment of a civil infraction or a finding of guilt on a criminal case the following points will be assessed to your license:

1.  Non-Moving Violation

0 points

2.  Moving Violation

3 points

3.  Speeding less than 15 miles over the speed limit

3 points

4.  Speeding 15 miles or more over the speed limit

4 points

5.  Passing a stopped school bus

4 points

6.  Moving violation (non-speeding) resulting in accident

4 points

7.  Unlawful speed resulting in an accident

6 points

8.  Reckless Driving (criminal traffic violation)

9.  Leaving the scene of an accident with damage

What action can I take if I have received notice of a ticket that I never received?
If you have reason to believe that you are not the person that has been cited for a civil traffic infraction you may submit a Request for an Identification Hearing and a Motion to Set Aside Drivers' License Suspension for any delinquencies that have resulted from failure to pay or appear in court.  If the offense is a criminal traffic violations, you will be asked to submit a motion to Set Aside a Bench Warrant to the presiding judge who will set the case for a motion hearing.  In order to take the above action,  you must seek assistance in person at any Clerk's Office location.

Can someone else appear in court on my behalf?
No, unless an attorney has filed an Notice of Appearance in your behalf, you must attend court when disputing a civil  infraction or when you have received notice to attend court on a criminal traffic offense.

Will Miami-Dade County tickets affect my out of state driver's license?
Yes, tickets issued in Dade County are reported by the Division of Motor Vehicles to other states.

How can I tell if court appearance is mandatory  in my case?

  • In addition to all criminal traffic citations; civil traffic citations, such leaving a child  unattended and those resulting in bodily injury require court appearance.

  • If there is a mandatory court hearing in your case the officer will write  “To be set” on your citation. 

  • You will receive notice regarding your court date at the address listed on the citation. 

Violation of Driver's License (expired less than four months), Registration, or PIP Insurance:

  • If renewal was obtained prior to the citation, submit proof within 30 days and the citation will be dismissed.  A $5.00 dismissal fee is required. 

  • If renewal was obtained after the issuance of the citation, submit proof within 30 days of the renewal along with a civil penalty in the amount of $47.00.

  • If you have not renewed your driver's license or registration at the time of payment, you may plead guilty to the charge and pay the civil penalty of $105.00.  If you have not reviewed your  P.I.P. Insurance at the time of payment, you must post a $150.00 bond and the case will be set for a court hearing. 

Violations of  Florida Statute 316.1935 "Improper or Unsafe Equipment"
You may receive a reduced fine on these violations, if you repair the defect within 30 days of the issue date.  Send written proof within 30 days that the defect has been corrected.  A $22.00 fine is required.

What is C.R.O.P.?
It is a 90 minute court program specifically designed for drivers who have been charged with a child restraint violation.  The program  is held at:

Miami Children's Hospital

Miami, Florida 33155

Participants must bring their child restraint seat to class.  C.R.O.P. is available only once in a lifetime.  Points are not assessed when defendants complete C.R.O.P. 

Once I elect   C.R.O.P. can I change my election and pay the fine?
No, once you have elected or have been court ordered to C.R.O.P. you must complete the course with 60 days of election or court order.

How can I get information on Parking Violations?
If you would like information regarding parking violations, you may  call the Parking Information line at (305) 275-1133. (See  Parking Violations Bureau). 

Can I plead "Not Guilty" if I do not live in Miami-Dade County?
Yes, you may submit a pleas of not guilty in absentia by posting a bond by mail (check or money order only) in the amount of the civil penalty along with a notarized affidavit of defense sent to:  Clerk of Courts, P.O. Box 02-5450, Miami, Florida 33102-5450.  The affidavit will act as your testimony in court.  Upon completion of the case, the court will notify you of the outcome.  If fines and or court costs were assessed, they will be deducted from the bond.  If the case is dismissed or you are found not guilty, your bond amount will be refunded.

Where can I reinstate my Driver's License?
If your driver's license was suspended due to failure to comply with a Miami-Dade County traffic citation you may reinstate your driver's license at any of the locations listed in question # 7 or any Division of Motor Vehicles location upon compliance.

What are my options if I failed to comply within 30 days?

  • Elect to pay the civil penalty or to attend traffic school.  You must include $16.00 in late charges to the initial penalty amount.

  • Request a court hearing up to 90 days after issuance of the ticket.  You must include $16.00 in late charges on tickets that are 30 days past the issuance of the ticket.

What can I do if I cannot attend my scheduled court hearing?

You may file a motion of continuance by mail or in person at least five days prior to your scheduled court hearing.

What can I do if I did not attend my scheduled court hearing?

  • File a motion by mail or in person to set aside driver's license suspension and have the case reset for court. 

  • Post a bond in person in the amount of the civil penalty to set aside driver's license suspension and have the case reset for court.

What to do if you are given a ticket for a criminal traffic violation or if you are arrested for a criminal misdemeanor offense and are released on a promise to appear?

Appear in court on the date and time of the notice you will receive a mail. Be sure that the address on your driver's license or arrest form is correct. The police officer will use this s your address and if it is incorrect, you may not get your court notice. If you discover after the officer gives you the ticket or arrest form that it does not contain the correct address call the Clerk's Office at 305-275-1111 for traffic tickets and 305-275-1155 for misdemeanor charges as soon as possible and give the deputy clerk the correct address or go to the Richard E. Gerstein Justice Building or any of the district court locations and fill out a change of address form. You may also submit your change of address by mail to the Clerk of Courts, County Court Division, and P.O. Box 02-5450, Miami, Florida 33102-5450.

If you do not appear in court at the correct time and place, the judge will issue a bench warrant. Anyone with a bench warrant can be arrested at any time by any police officer.
