Can I file document using electronic signature?

 

The ePortal authority has received permission allowing filers to use electronic signature.  Below are the acceptable signature types.

Signatures of Registered Users
A submission by a registered user is not required to bear the electronic image of the handwritten signature or an encrypted signature of the filer. Electronic signatures may be used in place of a handwritten signature unless otherwise prohibited by law. The information contained in the signature block shall meet the following required elements defined in Rule 2.515(a) and (b), Florida Rules of Judicial Administration. Additional information is optional.

Multiple Attorneys of Record Signatures
When a filing requires the signatures of two or more attorneys of record:

The filing attorney shall initially confirm that the content of the document is acceptable to all attorneys required to sign the document and shall obtain the signatures of all attorneys on the document. For this purpose, physical, facsimile, or electronic signatures are permitted.

The filing attorney then shall file the document electronically, indicating the signatories, (e.g., "s/ Jane Doe," "s/ John Smith," etc.) for each attorney's signature.

Original Documents or Handwritten Signatures
Original documents, such as death certificates, or those that contain original signatures such as affidavits, deeds, mortgages and wills must be filed manually until further standards have been adopted.

What is the eCourtesy System?

 

The  eCourtesy System  was established by the 11th Judicial Circuit to enhance the efficiency of judicial review of attorney submitted court documents for Special Set hearings and Motion/Foreclosure Calendar. The System reduces the quantity of paper involved in such review for the Circuit Civil Division by allowing attorneys to submit courtesy copies electronically to the Court.  Documents submitted via the eCourtesy System, must also be filed by the attorneys with the Clerk's Office.  The judge's staff only files with the clerk's office orders signed by the judge.

The eCourtesy System program has been expanded to all Circuit Civil Judges. The eCourtesy System is not an e-filing system, but rather, a program for submitting courtesy copies to the Court.  Visit Administrative Order NO. 09-13-A1 for more eCourtesy information.

What is ‘Moved to Pending Queue’ notice?

 

A filing will no longer be rejected for incorrect information but noted in a pending status for your attention. You will receive an email with the reason why it was not processed and have up to 5 business days to correct and resubmit the filing.

What is ‘Filed for Judicial Review’ notice?

 

It has been filed for Judicial Review in accordance with the Florida Supreme Court Standards for Electronic Access to the Courts, section 3.1.11, Local Document Receiving. Refer to Florida Supreme Court Standards for Electronic Access to the Courts for further information.

After I file with the eFiling Portal; do I need to provide a copy to the Clerks office?

 

No; as of June 16, 2011 follow-up copies are not required to be filed with the Miami-Dade Clerk's Office for Civil Division cases (Family, Circuit Civil, County Civil, Juvenile Dependency, or Probate).

What are the payment options available through the ePortal?

 

Authorized filers may access the ePortal and file documents at no charge unless a statutory filing fee is applicable.

The payment options are:

  • Credit/Debit cards:
    (MasterCard, American Express and Discover ONLY), 
  • E-Check / Electronic Check or
  • Fee Waiver

If a filer chooses to pay statutory fees using a credit/debit card, they will be charged an additional credit card transaction fee which will be used to cover the associated banking and merchant fees as allowed by Florida Statutes. There is a 3% statutory convenience fee for payments made via credit/debit card. The statutory convenience fee for payments made via electronic check (direct debit from a Bank Account) is $3.00.
