5. How do I know if I have to pay the re-open fees for a civil motion filed?

All motions filed will be reviewed by the clerk to determine if a re-open fee is applicable. If the clerk determines the motion requires a re-open fee, the attorney will be notified by email that a fee is required and the motion will not be processed until the fee is received. A $50.00 fee is required for all case types with the exception of SP cases which require a re-opening fee of $25.00.

6.  How do I file a subsequent pleading on a misdemeanor case?

To file a subsequent pleading on a misdemeanor case, the portal requires a court type to be selected. Since misdemeanor case types can be COUNTY ORDINANCE (CO); MISDEMEANOR (MM); MUNICIPAL ORDINANCE (MO); or NON CRIMINAL INFRACTION (IN), the filer may select either of the available choices if the actual case type is unknown. The portal knows the correct court type and will return it onscreen as a part of the validation process.

7.  Can I eFile a Motion to Seal or Expunge for a Criminal case?

No, as that filing requires the original certified document from FDLE with the raised seal.

8.  May I eFile an appeal with Miami-Dade County?

Yes, you may file an appeal, but you need to file the appropriate fee with the Notice of Appeal.
