How and where can I pay
the fine for a parking complaint (ticket)? |
|
There are four ways to
pay the fine for a parking complaint: in person, over the phone, by mail or
online.
-
You can pay the fine in person at the Parking Violations Bureau located in
downtown Miami at Courthouse East, 22 NW First Street, 4th floor, or at any of
the court locations listed under the Locations To Serve You
section and on the back of your ticket.
-
You can also pay with Visa or MasterCard by calling the automated voice
response system (24 hours a day) at (305) 275-1133.
-
You may mail your payment to the Parking Violations Bureau at Courthouse East,
22 NW First Street, Miami, Florida 33128, but the payment must be mailed so
that it is received before the late penalties are applied.
-
Online payments can be made through this site with Visa or MasterCard.

| 2. |
How soon after issuance
must I pay a parking ticket? |
|
You must pay the fine
within 30 days of the date the ticket was issued. On payment, you will be
deemed to have admitted the infraction and to have waived your right to contest
the citation. See the Fee Schedule for additional information. |
| 3. |
What happens if I don't
pay for a parking ticket on time?
|
|
A late penalty will be
added if the fine is not paid within 30 days after the ticket was issued. See
the Fee Schedule for additional information. The following
actions may result as well:
If you receive three parking tickets for any violation or one parking ticket
for a disabled parking violation, the Department of Motor Vehicles will be
notified to issue a deferral, or "stop," to the registration of any vehicle in
your name. To release the registration stop, you must pay all penalties due for
the tickets plus $6.00 for a certificate of compliance.
If you have five or more past due parking tickets or one past due disabled
parking ticket, a court order will be issued for the impoundment and
immobilization of any vehicle and license tag in your name. To release the tow
order, you will have to pay the balance due in full (by cash, cashier's check,
or money order) plus $6.00 for a certificate of compliance if your vehicle has
been towed, and you will also have to deal directly with the towing company for
towing and storage charges.
Parking tickets left unpaid for more than 90 days will be reported to an
outside collection/credit reporting agency. You will have to pay the original
fine and late penalties, plus an additional 40 percent of the total, directly
to the collection agency.
|
| 4. |
Are there options
available other than paying a ticket? |
|
If you are the
registered owner of the vehicle, or a person named in an affidavit by the owner
as having care, custody and control of the vehicle at the time of the
violation, you may raise your defense before the court at a hearing on the
violation.
Your request for a court hearing must be made in person within 30 days of the
ticket issue date at the Parking Violations Bureau located in downtown Miami at
Courthouse East, 22 NW First Street, 4th floor. If a registration stop has been
reported and you need a release, or if an impoundment and immobilization order
has been issued against your vehicle and tag, you must secure the total amount
due against your vehicle or tag for all other outstanding tickets by paying all
of the penalties or by posting a cash bond. An additional 40 percent of the
penalties will be added for tickets already referred to a collection agency.
Citations already referred to a collection/credit reporting agency must be paid
directly to the agency.
NOTE: Be prepared to introduce evidence at the time of the hearing.
It is important to know that when you elect to appear for a hearing:
You will have waived your right to pay the civil penalty
The court may assess additional fines, not to exceed $100.00, plus court costs,
(up to $253.00 for disabled parking violations)
Violators who fail to appear for court can be found guilty in their absence

What are considered
valid defenses and what are considered invalid defenses for a parking
violation?
|
|
Valid defenses may
include:
The offense was not committed
The vehicle was taken without my consent (stolen vehicle - submit theft and
recovery reports)
I was not the owner of the vehicle or the person having the care, custody or
control of the vehicle at the time of the offense. (A sworn affidavit is
required giving the name, address and driver's license number of the other
person so that they can be notified of their liability and can offer a
rebuttal.)
These excuses are not considered a valid defense:
Lack of knowledge of parking laws and regulations
Disagreement with the laws and regulations
Other vehicles also parked improperly or unlawfully
Late to an appointment
Disagreement with or inability to pay the fine
Parked illegally for only a few minutes, or only briefly, etc.
Directed to park at the location by someone other than an enforcement officer

What is a registration
stop? |
|
If you receive three
parking tickets for any violation or one parking ticket for a disabled parking
violation, the Department of Motor Vehicles will be notified to issue a
deferral, or "stop," to the registration of any vehicle in your name. To
release the registration stop, you must pay the total amount due in the
following order:
If applicable, pay the amount due to the specific collection agency, and then
pay the amount due to the Parking Violation Bureau.
If you need your tag renewed within the next seven days, you may appear in
person at the Parking Violations Bureau or one of our
District Court locations and pay an additional $6.00 for a certification
of release.
|
| 8. |
What is a tow order? |
|
If you have five or
more past due parking tickets or one past due disabled parking ticket, a court
order will be issued for the impoundment and immobilization of any vehicle and
license tag in your name. Your vehicle may be towed, or your license tag may be
removed. In this case, online payments to the Parking Violations Bureau are not
allowed.
If your vehicle has already been towed or the license tag has been removed, you
may do one of the following:
1. If applicable, pay the amount due to the specified collection agency and
then appear at the Parking Violations Bureau or one of our
District Court locations in person to pay the full amount due by cash,
cashier's check or money order, and pay an additional fee of $6.00 for a
certificate of release.
2) Appear at the Parking Violations Bureau or one of our
District Court locations to pay the full amount due and then pay an
additional fee of $6.00 for a certificate of release.
If your vehicle has not been towed, and the license tag has NOT been
removed, you may do one of the following:
1) If applicable, pay the amount due to the specified collection agency. The
tow order will remain in effect until your payment has been submitted and
confirmed by the Parking Violation Bureau. Allow two business days for the
payment to reach our office.
2) Appear at the Parking Violations Bureau or one of our
District Court locations, to pay the full amount due by cash, cashier's
check or money order. The payment will release the order to tow and impound
your vehicle or tag.

| 9. |
What is a bad check fee? |
|
A bad check fee is a service charge imposed by
Florida law when a worthless check, draft or order of payment has been used
to pay parking fines. The law provides that the service fee and the full amount of the
check, draft or order of payment must be paid to the Parking Violations Bureau.
|

What does it mean if I
have citations in collections and how do I contact the collection agency? |
|
If you have citations
in collections, it means that you have citations that have been left unpaid for
more than 90 days. The Parking Violations Bureau has given a collection agency
the power to collect payment for these citations. You will have to pay the
original fine and late penalties, plus an additional 40 percent of the total,
directly to the collection agency.
